Research On The Legal Problem Of Chinese National Economic Security

National economic security issue is an important problem of law which relates to the national economic development. The adjustment of the RMB exchange rate policy is influenced and constrained by the international economic environment more and more; Foreign banks and financial operations carried out in China, leading to the infiltration of a large number of foreign financial capital to China's national economic and social development in various sectors; Foreign-funded enterprises , especially foreign enterprises control over China's domestic market gradually; international trade attrition pricks up continuously; potential energy crisis, etc. these all influence the development of our nation economic and threaten our national economic security.National economic safety means that: the overall economic or the macroeconomic can develop healthy, continuously and stable, the national economic sovereignty and economic interests can be protected and fulfilled. Understanding from the essence , national economic security is a consciousness ,a governance idea penetrating into economic, social, political, and cultural , a nerve of the law and policy, a potential thinking control; national economic security is a kind of state, pursuing for relative balance, a kind of system can be protected by it ,a kind of interest can be expected, a state which can be realized; National economic is also a kind of law system, which can be operated and practiced through monitoring, pre-warning and evaluating .Under the condition of economic globalization, safeguarding national economic security need to deal with several contradictions: First, the contradiction between open and autonomous. We must safeguard national sovereignty and national interests, but also should participate actively in the international community, undertaking international obligations. Second, the contradiction between globalization and the national country. Every country insists in the independence of its state interests and national interests, but the globalization has an inevitable requirement for the elimination of national barriers, which leads to constrain and limit the sovereign power. Third, the contradiction between independence and corporation. The national countries seek to maintain the independence of sovereign decision-making, while at the same time, they have to integrate into international cooperation.
