Research On The Construction Of Legal Systems Of Electronic Wastes Management

With the fast development of the technical industry of electronic information, the pace of the electronic model change is faster and faster. Electronic wastes pollution, the new kind pollution has become another a loud social problem perplexing the development of human society already. The electronic wastes contain a large number of materials harmful to health and environment. If we adopt traditional ways, such as landfilling or burning briefly, to deal with electronic wastes still, the destruction to atmosphere , groundwater , soil is hard to assess, and then threaten the health of human being and the security of the whole ecology . Meanwhile, it is a kind of enormous resource wasting. So how to deal carefully with electronic wastes is a great subject concerning protecting of ecological environment and saving resource and realizing sustainable development. In view of this, some developed countries in the world, such as Japan, Europe's alliance , U.S.A. , South Korea , etc., have already begun its legislation of electronic wastes to manage it, and include it in track of recycle economy. Our country is still at the starting stage to the legislation of the electronic wastes, but the electronic wastes situation of our country is very severe. On one hand, as a large country in population, our country' s produce of electronic wastes is heavy, on the other hand , developed country shift a large number of electronic wastes to our country. So, it has very important meanings to set up and improve the system of electronic wastes laws and regulations of our country rapidly on the base of using the advanced experience that the foreign electronic wastes legislate for reference and combine the detailed conditions of our country. It will help to prevent and cure the pollution of electronic wastes to the environment effectively and promote the circling utilizing of the electronic wastes and save resources.This thesis began from introducing the concept, classification of electronic wastes, the current situation of pollution and recovering and handling of electronic wastes in our country. Then analyzed the dangerof electronic wastes to the ecological environment and pointed out the question existing in the management system of electronic wastes in our country at present. After that, the thesis introduced the foreign legislative state of electronic wastes and main legal systems. Then the thesis described the guidelines and basic principles that our country constructs the legal system of electronic waste management. At last, on the basis of using foreign advanced experience for reference and combining the detailed conditions of our country, especially constructed some main legal systems, including extending producer' s responsibility, depositing, the licence to recovery and deal with electronic wastes, recycling utilizing industrialization and precautions against shifting electronic wastes across border and precautions against "green barrier" related to it etc.. The main aim is the hope of offering some valuable research results for our country' s electronic waste management legislates.
