With the fast development of the technical industry of electronic information, the changing pace of the electronic products is faster and faster. Electronic wastes pollution, the new kind pollution has become another big social problem perplexing the development of human society already. The electronic wastes contain a large number of materials harmful to health and environment. China is still in the first stage of Legislation of electronic wastes, but reality of the problem in China is very serious. On the one hand, huge population result in huge electronic wastes; on the other hand, without the recycle the disposal system of electronic wastes cause the wastes were mistreat by unlawful workshop, leading to a series of environmental and resources problem eventually. Therefore, it is very important to set up the system of electronic wastes laws as well as the system of recycle and disposal through learning overseas experiences. It is meaningful for resources saving and environment protecting.The first part of this thesis start from the concept, characteristic and the pollution reality of electronic wastes, then it analyzed the damage to ecological environment and pointed out the question existing in the management system and the reasons. The second part of this thesis afford to some meaningful suggestions through introduced the management and legislative experiences from foreign countries. From two levels the third part of this thesis pointed out the questions exist the E-waste legislation. The last part of this thesis described the guidelines and basic principles that constructs the legal system of electronic wastes in our country. Offering some valuable research proposal for legislation of electronic wastes management is hope of this thesis.
