Therefore It's necessary to discuss the legal rights of teachers and their legal protection.The status of civil servant of teachers should be established teachers should be administered directly by the government which are make for improving the social status of them and the development if education in our country.Teachers as educators should entitled the legal professional rights according to law such as the right of teaching and education, acquiring the payment and treatment, democratizing management, continuing education.Our social realistic shows a great deal of damages in teachers' legal rights such as the right of teaching and education being deprived, severe payment in arrears in some places, the breaking time being occupied forcefully, the democratizing administering not being completely fulfilled, so as the continuing education.Although the legal rights of teachers are protected by substantial law and the procedure of the conclusion of treaties, legislation of education still exists loophole. Damaging teachers' rights mentioned above is closely related to a series of problems of the protection from law for the legal rights which are blurred status of civil servant for teachers, unequal legal status, few legislation for teaching and education, existing loophole, short of channel of legal help and information, unstrictly executing law all leading to damages of the rights.The teachers rights were severe damaged which hindered the project of education. To ensure the legal rights and accelerate the development of education healthily we can enhance the power of protection for teachers' legal right as follows: establishing the appointment system as soon as possible, amending and completing some clause in Teacher Law, completing the channel of legal help for teachers' right and interests and establishing the system of arbitration.
