On Judicial Processing About The Bribery Case At The Village Committee Election

This research takes the bribery case at the village election in village self-governance as the basic point. We will point out the necessity and deficiency and countermeasure of judicial processing about the case of bribery at an election by the case investigation, individual interview and some other place cases. We will try to discuss the importance of judicial processing with regard to norm and democracy and legal system of village self-governance. The entire article is divided into five parts.We will introduce the angle and backgrounds of this research in the first part. Analysis and discuss is carried on existing research achievements by recollecting related documents. Simultaneously we make an explanation for the method and train of thought of this research.Secondly, we will make an explanation for the necessity of judicial processing about the bribery case at the election in village self-governance. We divide it into tripartite: external behaviors and characteristics of the bribery case at the election; analysis of causes of the bribery case at the election; the value of judicial processing. Behaviors and characteristics and form courses is described by plenty of cases. Ration choice theory and system- behavior pattern is put into use.In Part III, we will analyze a main problem of judicial processing about the bribery case at the election in village self-governance. It spend four arrangement of ideas including two holding together: the boundary inactivity of the bribery case; the determinacy inactivity of judicial processing; the difficulties of inquiring into and obtaining evidence in judicial processing; block of wood flexibility of court's trial.Perfection and solution of judicial processing is expounded about the bribery case at the election in village self-governance depending on the fourth part. We carry on the explanation from two aspects: legislation and procedure.Finally we will summary research conclusions and carry out investigation and discussion. We point out that judicial processing is an important solution for the bribery case at an election. We think that judicial processing is an effective method of perfect electoral system in village self-governance. It will drive democracy and legal system of village self-governance. At the same time, we give the explanation and self-examination of insufficient place about this research.
