| The residents' committee system was established along with the socialism political power establishment. In the past more than 50 years, The residents' committee, as our city basic-level organization, has solved city people's life difficulties, simultaneously it has also played the vital role in connecting the city peoples and the basic units of political power. But, in this process, it, not on own initiative, has acted as the basic unit of political power to manage the city, losing the nature of autonomy it must have originally.In this article, the author draws out the universal questions which at present exist in the city residents' committee system in our country through introducing the case of W community of Shanghai City, namely administrative organ intervention to residents' committee in our country. It is the legal deficiency and wrong operations that caused residents'committee system to deviate the correct developing direction, and it has becomes the branch of administrative. But, the reality causes us to think about the questions that exist the residents' committee system. As citizens′right consciousness of comes back as well as the Market economy system is established, especially constitutional amendment promulgated in 2004 and property laws in 2007, real estate as a part of citizen's legitimate private property receives constitutional and legal protection, which propose a big challenge to residents' committee control system. How can residents' committee come back and become true mass autonomous organization? The author has mainly carried on the consideration on three ways: on the legislation way, on the administrative way and on the judicial way, and propose the own viewpoint: The government must not intervenes the residents' committee, but safeguard the residents' committee system. The residents' committee system is not merely a system question, moreover is a constitutional question to the rights of citizens protection.
