The Research On Citizen Participation In The Legalization Of Public Policy

As Public policy is becoming more scientific, democratic and legal, it requests the decision-making model to change from elite to mass participation. In a modern democratic society, the citizen is both the subject and object of public policy, but the attention to civic participation in the public policy-making process is far from enough, and the civic participation mechanisms is immature, these lead such as collective petition, and other phenomenon of non-institutionalized participation.Therefore, from the concept of the legalization of public policy, I inspect the actual situation on public participation in the formulation of public policy recently in this paper. In our country, the needs of socialism democratic politics as well as the development of socialist market economy request us to have to introduce the citizen participation into the public policy legalization process. At present, there are good organization resources, information and technology resources as well as legal resources, simultaneously there are many kinds of way you could choose, such as the poll, the policy-making consultation and the public consultation and so on. These provide advantages to the citizens participate in the public policy legalization, However, influenced by the subjective factors, the system and the practical factors, there exists the passivity, randomness, the lack of the right of the civic participation and such various problems in the public policy legalization process. These problems seriously weakened the validity of public policy. Therefore, as how to promote the citizen participation in the legalization of Public policy, to enhance the legitimacy of public policy, the paper made the following concludes: First, raise the awareness of the participation of citizens through cultivating "active participation" and "democratic values" and awareness of social responsibility, through vigorously developing of cultural, education and technology, enhancing the effectiveness of citizen participation and so on to develop the ability of citizens' participate in; Second, improving the systems of civic participation, including adjusting of the government information disclosure system, innovating society and the public opinion reflected system, operating of the public consultation system reasonably, so as to make civic participation into an institutionalized one; Third, constructing supervision and relief system of civic participation. Ensuring that public interests which are impaired can be legal relieved effectively by means of judicial review, the key is to improve the systems such as administrative proceedings. As the socialist market economy is deepening, new social groups has appeared, the situation of diversified interests has formed. Under this background, the study of civic participation in legalization of public policy is to explore the perfect expression mechanism of the interests of social groups. This is conducive not only to ensure the people's right to know, the expression, and supervising, and other basic rights, but also conducive to the building of a harmonious interests and realize a harmonious socialist society.
