Energy is not only the economic and social development of material support, but also the energy consumption on the environment has a tremendous impact. To the development and use of energy resources while protecting our planet, on which, we live and the ecological environment. Countries in the world have opted for a sustainable energy development strategy. Of course, China as a sustainable development path of the developing countries should be no exception, and giving priority to the development of new energy, especially renewable energy, eco-industry is the main content Energy is promoting the sustainable use of important aspects. To promote renewable energy in China's development and utilization must be the promotion of renewable energy development and utilization of policy measures into the legal track. Thesis by comparing the in-depth investigation of energy security situation at home and abroad of China's renewable energy potential development space, Analysis of the existing domestic and international renewable energy law and the implementation of the system, at this stage in China's development of renewable resources and the status quo.Further integration of the recently promulgated"China Renewable Energy Act"proposed policies and regulations related to the details of the development and implementation of recommendations. The Act involves some important institutions: the total renewable energy target system, renewable energy generation and net approval and full acquisition system, renewable energy and cost-sharing Internet tariff system, renewable energy in special funds and tax credit incentives, and other important legal system. Throgh administrative and market incentives, guide and inspire various economic entities to participate actively in the development and utilization of renewable energy, increase energy supply, improve energy structure, and guarantee energy security, the protection of the ecological environment achieve to sustainable economic and social development. The Act is a major step for China's"green"energy and laid the foundation for rapid development. Viewing form the contents, the act is on the whole policy framework, many of the specific contents of the relevant government departments have yet to be made clear, these provision is the cirtical to the renewable enerty law. Many countries in the promotion of renewable energy development and have enacted legislation, the United States, Germany, Britain, Japan and other countries can be said to be taking the forefront of the countries in the world, and its related legislation is worthy of consideration, a number of reference the law.Papers generally divided into four parts, the first part of the current world's energy security problem leads to the world of renewable energy development and China's development of renewable energy use status of the world renewable energy development trends and briefly that the current renewable energy in the legal system to be perfected. It introduces the concept of renewable energy and basic profiles from the current world's energy security promble.China's development and utilization of renewable energy in world will have a better further. The second part is the status quo of China's renewable energy into the legal system. This part describe the renewable energy-related laws and regulations, as well as the assessment of China's renewable energy-related legal system. China's renewable energy development later in the country's renewable energy law introduced in the past few decades, China's energy management relied mainly on administrative measures, although the regulations, rules, the system also attached great importance to the development, but can really rise to the provisions of national laws and regulations. Therefore, the January 1, 2006 start of the implementation of the "People's Republic of China Renewable Energy Act" (hereinafter referred to as "Renewable Energy Law") in China's renewable energy is very important significance. The third part of this essay introduced renewable energy sources on the legal system of serval foreign countries, compared the achievements on legal system respectively and summarized their effects on China's legal system.Looking at countries in the world for the development of renewable energy resources developed by the mandatory laws and regulations, especially the four forefront of this field:the United States, Germany, Britain and Japan, the fundamental legal of which is to promote renewable energy development by mandatory requirement and take specific measures to protect the economic incentive in implementing the law.The existing legal framework in principle and the specific provisions supporting the policy should be revised and improved according to the actual needs and the objective situation changes.Despite the foreign countries solve the problems of developing renewable energy through legislation. As an illustration, the terms were too specific, the goals were too ambitious in some countries and some legal stability were poor. However, we attach much importance to their experiences.Together with the practices, most of the experieces are of great significance to China. The last part firstly analyzes the existing problems of China's renewable energy law system. The development of China's renewable energy is late, The pace and the overall level of development is still far lower than these most developed countries, And it also lags behind of India, Brazil and other developing countries. Generally speaking, China's legislation of renewable energy is based on the model which is established by the promotion and leading of government, Therefore, the legal system still exist many problems, Such as the insufficient understanding of the development of renewable energy resources, The mismatch of Many policies and regulations, the unsatisfactory results of Implementation, the unsatisfactory results of Implementation, the unsound mechanism Financing, the weak capability of R & D, the relatively low level of technology and equipment manufacturing. On the basis of analyzing the exiting problems of the legal system of renewable energy, firstly thin or supplement the supporting legal system, Second is to coordinate the relationship between relevant policies and legal systems, Thirdly, implement the existing security system of policies and laws, Fourth is combing efforts to strengthen the management system of supervision, Fifth is a market-oriented approach and public participation, Sixth is to assess the implementation of the policies and laws, adjust legal measures timely. Put forward the Proposal for the establishment of sound system of renewable energy, With a hope of that in the environment of the legal system, China's renewable energy can be healthy and rapid development, so as to promote China's sustainable development process.
