Nature Reserve is specific regions to be protected by law. It is the protection of the environment and natural resources, and it is the most directly reflect of harmonious development of human and nature. Since 1872 the United States established Yellowstone National Park, the world has established more than 100,000 various types of nature reserves, some countries have formed a sound legal system about Nature Reserve, Played a good role in protection of resources. Along with the development of nature reserves, China has executed a large number of law in the establishment, construction, protection and management of nature reserves, which has made noteworthy achievements in the world.With the expanding of nature reserves, the increasing of the complex objects, the contradiction between protection and development, management and supervision of the nature reserves became more and more important. But the legal protection is obviously out of date on the needs of practice. Therefore, this article studied several issues on the legal system of nature reserve. Firstly the article introduced the basic theory of China's nature reserves including the concept of nature reserves, classification, construction and other basic questions. Secondly the article analyzed the development and the current situation of the legal system of nature reserve; analysis the existing problems and the reasons of the problems, at the same time make some suggestions to improve the legislation on Nature Reserve on the basis of the advanced experience of foreign countries.At present, the legal system of nature reserves in China is imperfect; the law is on the low level and there is a conflict between the laws. In order to carry out the work of nature reserves, we have to perfect the legal system of nature reserve by obeying the principle of balance and sustainable development and the other new ideas. We should develop a comprehensive legislative and we should change the relevant laws and regulations so as to form a comprehensive and complete advanced legal system. In addition, the existing management system is not completed, the government doesn't pay enough attention to this area, public participation and economic compensation system is not perfect, and legal liability is improper, so that we can not achieve the purpose of the protection of nature reserves. According the practical manage and protection needs of nature reserves, we should construct a new administrative management system and improve the management of nature reserves; we should enhance government input and their own income to provide financial support for the protection of nature reserves; Finally, it should be to strengthen the legal responsibility to protect nature reserve.
