The Plight And Way-out Of Our Country's Petition System

In China, the Petition system is an important input system within the political system, is playing the interests of expression, democratic supervision as well as the relief rights function in the real life. But with the rapid economic development and social transition, increasing dominance of the deep-seated contradictions, the benefit pattern's adjustment and the conflicts of interest are day by day intense. Since the mid-1990s, more and more large-scale collective petitions and the contradictory intense individual petitions have initiated the phenomenon of "Petition peak". In order to maintain order, to maintain the government's close relation with the masses, to protect the legitimate rights and interests of petition, in 2005, the State Council promulgated the new "Petition Regulations." However, the phenomenon of "Petition peak" has not been weakened with this new regulations promulgation. Faced with this situation, the Petition system is facing unprecedented difficulties. This essay is to be written with this background.Full-text is divided into five parts:The first parts, explain the background of the issues, introduce and evaluate the current domestic research on this subject, and propose the method and idea of research on this basis.The second part, take the political system theory as the theoretical analysis tools, elaborate the Petition system as an important input system within the political system, playing the expression interests, the democratic supervision and the relief rights function in the real life.The third part, a detailed analysis of the current difficulties faced by the Petition system and the reasons:On the one hand, petition problems are many and complex; On the other hand, the input channels of Petition system as well as other channels of expression interests and relief rights associated with the Petition system have malpractice, makes the current " request" channels of expression interests not clear, excessive petitions influx in the petition channels which itself is defective, leading to input overload, far beyond the capacity of department's handling ability, which in turn led to the vicious circle of output failure.The fourth part, propose the ways of solution input overload:On the one hand, reduce the quantity of "the request" which through the structure mechanisms and the cultural mechanisms to amend the requirements of the content (here, "the request" refers to petitions); On the other hand, by improving the petition and other related input channels as well as reduction petitions in the public interests of input process to broaden the channels for expression, and relief rights channels to improve the channel flow capacity, ease the pressure of Petition system. By this comprehensive program manage input overload problem of the Petition system.The fifth part, propose the countermeasures of governance output failure:Petition system has a variety of defects in common which causes the situation of output failure, and therefore the Petition system must be improved. First, relocate the function of Petition system which is proposed priority to weaken relief rights function; then elaborate specific ways to improve this system:Perfect the legal framework of Petition system, integrate the organization of Petition system, standard the disposal procedure of Petition system, sound the end mechanisms of Petition system as well as improve the responsibility mechanisms of Petition system. Enable them to better handle people's petitions.
