Countermeasure On Disassimilation And Rectification Of Administrative Accountability System

Administrative accountability system is the essential requirement for the construction of responsible government, an important guarantee of the construction of law-based government and also the institutional guarantee to strengthen the supervision and restraint of government power, upgrade the implementation capacity and public credibility of the government. The original idea of administrative accountability system is to implement responsibility investigation of the administration staff who don't fulfill their duty, to require them to assume the corresponding political, moral, administrative and legal responsibility, and to accept the negative consequences of various punishments. However, in the implementation of administrative accountability system, those who exert power deviate the original idea of administrative accountability system because they control the formulation, implementation and evaluation of the administrative accountability system, which leads to some disassimilations of the system: such as valuing more official will than public will, emphasizing misact more than mistakes of decision-making and so on. These disassimilations can be attributed to the following factors:deviation in cognition, lack of sense of accountability, omission of legal rule, difficulty of accountability according to law, confusion over rights and liabilities, incompleteness of system and inadequate information disclosure. This thesis aims to explore the thread and countermeasures of preventing the disassimilation of the administrative accountability system from four aspects:Firstly, the cultural construction of administrative accountability should be strengthened. Secondly, the legal construction of administrative accountability should be tightened up. Thirdly, the accountability system of tort compensation and recovery should be perfected. Fourthly, accountability evaluation system and accountability relief system should be set up. Next, information enclosure should be enforced and a public complaint system should be set up. Finally supervision should be strengthened and a three-dimensional supervision network should be set up.
