The Supervision And Perfection Of Implement Of Village Committee's Authority

Since 1987, "The People's Republic of China Village Committee Organization Law (Trial Implementation)" was promulgated; the villager autonomy system has gone through more than twenty years. Although, in more than 20 years, the central and local governments devoted a great deal of energy, and had made gratifying achievements, in real life, there are still many problems of the villagers'self-government. In particular the abuse of the village committee, damage the interests of villagers, has become an urgent issue to solve in the village self-government. This article from the village committee to exercise oversight authority point of view to analyze and promote the corresponding method. In this paper, from the perspective of "village committee supervision", I talk about this problem and suggest some methods.The first part of the content outlines the villager autonomy from the connotation and legal nature perspective.In the second part, the duty of the village committee is discussed from the Constitution, the village committee organization law, administrative regulations, local legislation and administrative regulations perspective.Part three focuses on the issue of the village committee in the course of exercizing. First, talk about the problem of members of village committee supervision, on one hand, the law gives the villager meeting the right of supervision to supervise the village committee; on the other hand, gives the right to the village committee to have villager meeting. However, there are contradictions between the two hands. Second, the terms of reference between the village committee and village party branch cannot be clearly classified; Third, there are overlapping of the institutions and organizations between the village committee and the collective economic. Fourth, the division issue between the exercise right of village committee and the administrative functions of township government, the devision has the performance in two aspects, namely, the township government's erosion and violation of village governance and the expansion of the villagers' autonomy.Partâ…£improved five aspects to polish the exercise oversight authority of the village committee. First, the improvement of legislation in the monitoring (mechanism), the approach is to establish a supervision system and the establishment of village monitoring the implementation of village affairs agencies; Second, improving the executive authorities of the village committee of exercise powers of supervision, the way is to improve the supervision and guidance and to improve the monitoring of the cadres, establishing a good filing system for the village financial independence; Third, improving the functioning of the village committee of judicial supervision, and establishing the village committees dominant position of administrative litigation; Fourth, improving the supervision of the mass media, and using the mass media to exert pressure of public opinion to the illegal exercise of the village committee's power; Fifth, improve the functioning of the Party's supervision on the village committee, and divide the responsibilities between the village Party branch and the village committee, and focus on the importance of the Party's leadership.
