Research On Legal Support System For Entrepreneur Of Home-going Peasant-workers

At present, China is in the process of gradual deconstruction of dual economic structure and binary social structure, along with the population, capital, technology and other production elements flowing between urban and rural areas and re-configuration. Peasant-workers, as a special group between the public and the farmers, the workers and the peasants, are also showing a two-way, reversible, complex flowing characteristics and developing trend. Entrepreneur of the home-going peasant-workers brings not only the re-allocation of production factors, more importantly, promotes a new rural construction, developments in central and western China and small towns, at the same time, it is also important to economic development and social development . More and more researchers have realized the support to the Entrepreneur of the home-going peasant-workers is an important, urgent and complex systematic engineering and it is necessary to make a deep analysis and discussion of the home-going peasant-workers and also the policies for them. Relative to economics, management science, sociology, law research relatively gives little attention to the Entrepreneur of home-going peasant-workers. Economic law, as a responsive legal discipline, should think of this issue and respond to it. Scholars always give supports from the theoretical level and the government gives support from a practical level, but because there is no study from a legal perspective, there is no legal-oriented and systematic efforts, which are lack of stability and long-term nature in economic conditions. Economic law is the basic legal form to regulate the state intervention in the economy. For this reason, the economic law research is necessary to respond to the current situation in order to promote the development of the Entrepreneur of the home-going peasant-workers. Based on the reflection of the policies supporting the Entrepreneur of the home-going peasant-workers, this article tries to find out the theory and institutionalized and systematic supporting policies.This article includes four parts together with the introduction.The first part is an overview of the Entrepreneur of the home-going peasant-workers. At first, it defines the content of the Entrepreneur of the home-going peasant-workers. Then by giving a detailed analysis of the basic situation and developing trend of the Entrepreneur of the home-going peasant-workers, the part tries to grasp the pulse and demonstrate the feasibility to build a support system for it. At last, it reasons the necessity and urgency to build this system through analyzing the era background and the practical meaning to our country.The second part talks about the train of thought to construct the legal support system. This part focuses on the aim, the base and the implementation mechanism. It points out that the institutionalization is the base, the specific directing thought is the precondition, the specific group is the key and the proper supporting approach is the major point.The last part is about the construction of the legal system supporting the Entrepreneur of the home-going peasant-workers. Based on the analysis of the difficulties the peasant-workers facing, in accordance with the thought to construct the legal supporting system, combined with analyzing the effectiveness of the current support measures, taking the economic law as the viewing angle, the part respectively goes into the incubation platform, the main business, financial and taxation support, financial support, premises, risk and other aspects of the system and resolves the concrete proposal.
