The Thinking About Rights Of Village Elections Relief In China's System Of Village Self-government

Village self-government system is the mass self-government system which appears after the power vacuum in rural areas from the beginning of the reform and opening up. Village self-government system is also a self-government system which created by the farmers with their intelligence and wisdom, and it's formation of grass-roots. In so a big agricultural country like China, it have made outstanding contributions to China's political and economic development in rural areas, and also made outstanding contributions to the social order and stability. It became a basic system of the China's rural areas. But, after carried out for 30 years, there are still many problems especially in the democratic elections which as the basic of the Village self-government needed to resolve. Chinese scholars have tended to study the Village self-government from the perspective of political science or sociology, but in this article, the author with relevant national legal systems as the basis, select the entire system of village elections in the most critical rights, in combination with part of the case and legal theory, focused on the election of village rights have been violated and the corresponding countermeasures, to the rights of Chinese farmers may seek relief mechanism was discussed to ensure that villagers can truly democratic elections, thus ensuring the basis of village self-government autonomy.In the part of introduction, the author made a brief introduction of the Village self-government first, and then emphasized the importance of the electoral rights in the system of village self-government, and pointed out the phenomenon that rights have been violated in the village elections but no relief still remain. The first chapter introduces the concept of electoral rights of villagers by the villagers the right to vote, and the distinction between the villagers the right to vote, outlines the content of the villagers and the nature of electoral rights, and pointed out the relevant provisions of the rights of village elections in the current legal system in China. The second chapter describes the status of the rights of village elections, focusing on the electoral rights of villagers affected by the fact that violations were summarized by its step by step in accordance with the villagers have been classified in the electoral process, and a brief description of the electoral rights have been violated, but the villagers denied relief hazard. The third chapter first analyzes the current system of village elections the right to relief to various relief methods advantages and disadvantages, and then targeted to address the recommendations highlighted by amending the existing relief system and adding new remedy, the right to relief to improve the existing system of village so that vast numbers of villagers after the rights had been violated in a timely and effective relief.This article is hope that by studying the electoral rights of villagers relief system, guarantee the rights of the villagers do have elections under the premise of autonomy, voluntarily express their wishes, making the village election system truly reflects the will of majority of the villagers, leading to the health system of village autonomy to the pre-development.
