The Theory Research For Establishing The Legal System Of Ecological Agriculture

With the rapid development of society, the chemical agriculture has not met the development needs of modern socialist new rural construction, and restricted the sustainable growth of China's rural economy. The implement of chemical agriculture has made more serious environmental problems in rural areas. Therefore, China has put forward ideas of striving to develop ecological agriculture in the 1980s, meanwhile according to this agriculture, our country has carried out some series of polices, regulations and management methods for the purpose of the legislation of ecological agriculture. So as to promote the legislation of ecological agriculture, this thesis probes into the theories, methods and constructing contents, and the main conclusion is as follows:The construction of the legal system of ecological agriculture, from the macro theory I have theoretical consideration, that is as the theoretical basis of the legislative theory of legal system of ecological agriculture, ecological theory and ecological agriculture theory, the theory of circular economy, the sustainable development theory. At the same time, I put forward the construction approaches from the legislative, the legislative technology, and ecological point of view.The construction of the legal system of ecological agriculture, I have the research from the constructing content. The constructing content is mainly about: improving the ecological compensation mechanism (that is, the sound ecological system of agricultural subsidies, eco-agricultural insurance system, the eco-tax system), improving the standard system of ecological agriculture (the standardized determination of pollution degree, improving eco-labeling system, making measures of development of ecological agriculture standard system), the construction of ecological agriculture and industrial systems, the establishment of economic incentive systems, the improvement of supervision and management mechanism.I probe into the problems, these are about the process of agriculture development which brings about the ecological environment problem in Yanling County, and the process of developing ecological agriculture, due to the lack of legal system. And I advise that we should put forward to the regulations and management methods about ecological agriculture all over the country, in order to make these up to the level of laws.
