Research On Legal Protection Of Technological Innovation

Technological innovation is a serial of activities, from the broth of a new idea to product design, trial-produce, produce, sale and marketing namely the creation, circulation and application of knowledge. The key point is to achieve the integration of technology and economy. The process of economic globalization in recent years proves that technological innovation has become the major driving force and key factor in promoting the economical development of every country. Drawing on the successful experience of developed countries, the law is the most effective way for the protection and promotion of technological innovation. Therefore, the research topic of this paper is "legal protection of technological innovation".The thesis consists of six parts.The first part is introduction, which presents the purposes and significance and the status quo of the study, and the research methods employed in the paper. Based on a brief summary of the legal protection of technological innovation at home and aboard, the paper points out the necessity of perfecting the legal protection of the technological innovation. It also tells the innovative part of the thesis, namely the author proposes that the resources for technological innovation should be protected, through legislation, during social sectors integration. Consequently, the law for technological innovation protection is of the same need. Therefore, the relevant legislation should be systemic. The second part defines the concepts of technological innovation and legal protection, clarified the four basic principles which must be abide by the legal protection of technological innovation.The third part analyzes the current situation of legal protection of technological innovation in China. The legal protection of technological protection mainly focuses on intellectual property protection. The legal protection of other areas is not systemic and the legislation level is low. The author points our several problems existing in the current legal protection of technological innovation, such as the social relationship created by technological innovation has not been completely adjusted by law, lack of law and regulations to model medium and small companies'technological innovation.The fourth part compares China with some typical innovation-oriented foreign countries, such as America, Japan and Germany, whose advanced experiences on legal protection of technological innovation have left China with many inspiration.The fifth part focuses on the problems in China's legal protection of technological innovation and the relevant experience drawn from other countries, proposes to legislate and protect related laws and regulation to protect technological innovation in China. The sixth part summarizes the basic opinions and innovative points in the paper.
