A Research On The Reform Of China's Petition System

When all the people of the nation are struggling for socialistic harmonious society, the new round of unexpectedly petition peak is coming. As the Chinese characteristic mechanism of citizen politics participation,citizen supervision and civil right relief, when confronted with the strike of the petition peak, the petition system has exposed many problems and shortcomings. A mass of skipping petitions,group petitions and group events are hindering the building process of the construction of the harmonious society. In this context, the mission of both theoretical and practical circles is reviewing the system of petition and exploring a proper reform way.The first chapter of this thesis clears up and defines the concept of "petition", demarcates the intension and extension of "petition", these efforts lay the foundations for the later discussion. The second chapter traces the activities of petition in ancient China, examines the process of petition emergence, development and perfection, and deepen the understanding of petition. The final section of this chapter analyses the background of petition reformation. By analyze the text of "Petition Regulation" which was promulgated and implemented in 2005, the third chapter discuss the breakthrough and innovation of the new regulation. The fourth chapter points out that although the current petition system have many breakthroughs and innovations, there are still many limitations, then analyses these limitations. The fifth chapter discuss the legitimacy of petition and,by learning the experience of west Ombudsman and petition system, the author gives his reform proposals-one core petition system which is leaded by the People's congress.
