According to the Marxist theory, the virtue of human rights improvement means the development in every respect of the whole society. Only a developing productivity can ensure a sustainable promotion of human rights status. People are the most important social productivity and the development of productivity leads to both plentiful living materials and significant scientific progress. As a developing country with a large population, China adopts the family planning policy based on the real situation to improve the human rights status. Since carrying out this policy from 1970s in every corner of China, significant achievement has been made. The population is increasing in coordination with social and economic progress, and citizens' subsistence, development, cultural, economic and social rights have been improved remarkably, leading to overall promotion of human rights status. This paper analyzes how the family policy helps improve human rights status in China and argues that the family planning policy functions in two levels progressively, namely subsistence right and development right. It also exposes the true colors of some organizations and individuals who use the family policy as an excuse to criticize the human rights status in China with their own ulterior motives, and puts forward associated proposals and solutions.
