Research On The System Of Public Security Organization Of Public Institution Of Higher Learning

With the constant promotion of reform and opening-up of our country, the high educational undertaking has entered into a brand-new stage, and the reform, development and stability of the university are facing the new problem and the new challenge too. The stability is the prerequisite of reform and development, and the stability of the public security are important especially, and public security of university only ensures other work can launch smoothly. But in recent years, peripheral and inside public security situation of university becomes severe, and public security state goes from bad to worse, which interfere well-balanced teaching, scientific research and life order of university badly, and endanger the public security of university and the stability of civil order directly either. The past university public security organization is regarded as mainstay of safeguarding the public security of the university, and has safeguard university's teaching, scientific research and life order effectively, and has ensured the legitimate rights and interests of teachers and students of university well, and has made enormous contribution for keeping the social security. However, as our country run the country according to law, the political structure reform is being deepened and the socialist legal system become better and approaching perfection day by day, the drawback that the system of public security organization of university is not smooth has become more outstanding gradually, and has already become enormous obstacle of attacking the behavior of breaking laws and committing the crime in the university, safeguarding university's public security at present. With the deepening of the political structure reform of our country and legal system was perfect gradually, the system of public security organization of university changed gradually from 1992. The public security organization of university was cancelled in this period, and was resumed the inside functional department, and the station accredited or built up formal police organization in the university in addition. Secondly, according to the historical evolution of and the development of functions and powers of the public security organization of university, it describes the characteristic of the public security organization of university. (1) The functions and powers of the public security organization of university go through from extensive authorization to restricted authorization to canceling police power totally. (2) What the public security organization of university executed mainly is national police power. (3) Establishment and leadership of the public security organization of university are different from social police station. Second part explains the necessity of the system reform of public security organization of public institution of higher learning. First of all, the system reform of public security organization of university is a need of perfecting the national political structure reform. Secondly, the system reform of public security organization of university is a need of safeguarding the public security of university and even the social stability at present. Moreover, the system reform of public security organization of university is a need of managing school in accordance with the law and perfecting socialist legal system. The third part explains the analysis of several kinds of modes of thesystem reform of public security organization of public institution of higher learning. The first is cancellation mode. Namely the public security of university all cancel, and the safeguard organization of university is resumed and is responsible for safe prevention work of the public security of university, and the state does not accredit the police entering the campus separately, and the criminal cases and the peace cases of university are under the care of local police station. The mode has not the maneuverability in practice and is adopted scarcely in both theory and practice, so no longer is discussed in detail here. The second is dual track system mode or Wuhan mode. Namely it insists that the safeguard organization is set up, and the police organization is set up led directly by the police station in addition and manages one or several universities at the same time. The police organization of university is under the jurisdiction of local police station and is totally managed by the police station of higher level. The police service function of the original public security organization of university is canceled, and the security department of university is resumed. It is that "two organizations are set up separately, two functions are separated, and two teams are divided and built "basically. I think the imagination which policeman is accredited to university is reasonable and necessary, but it is unnecessary to manage all public security service of university and supposed to distribute some power to university properly. The third is restoration mode or Shanghai mode. Namely the public security organization of university is rebuilt as new public security organization, and is under the jurisdiction of police station of province and city, and former public security cadres are absorbed and employed again if passing the examination, and are awarded the police rank. And, these police organizations of universityaccept the leadership of the school and education department also in the form of security department of university. The organization way and the management system are the same as that of the former public security organization of university basically, and the public security organization of university is "the same batch of people, two brands ". I agree that the university can enjoy the some police power, but can only be in the form of delegation of administrative power, and disagree with the imagination that university sets up the police organization accepting the double leadership and personnel is awarded the police rank but under the jurisdiction of university. The fourth part explains the suggestion and imagination on the system reform of public security organization of public institution of higher learning. First of all, it describes that the organization structure of safeguarding the public security of university. University should have police organization and own public security department coexistent. Secondly, it describes the relation of university, public security department and police organization of university.
