Since the 1980s, private education has been developed quickly with a large number of private primary schools and middle schools rising. However, the backward group of teachers in those schools has greatly threatened the existence and development of private primary schools and middle schools. The main cause for this problem is that the teachers in those schools have found themselves in a woeful predicament of lack of rights for a long time. Their legal rights are occasionally violated without efficient protection. Corresponding with this, problems of teachers' rights in those schools have caused close attention and thought.From the viewpoint of teachers' professional rights by Law of Teachers, this article pays attention to the extent of protecting the teachers' rights during the teaching process and investigates the teachers' professional rights in Huaihua City, Hunan Province, actual protection and the differences between them by the means of taking sociology as a proof. It falls into four parts.The leading part probes into the definition for the connotation of law, legal conception of teacher, teachers' rights, private schools, teachers' status in those schools, the connotation of teachers' law and its items. On the basis of the six rights in Law of Teachers, the article mainly investigates 200 teachers from eight private primary schools and middle schools tike Yingcai Specializing College, Rencai Educational School and Xingguang Experimental School, by questionnaire and conversation from the early October of 2005 to the end of November.The next part counts and analyses the data and then makes 38 statistical graphs. The investigation shows: teachers' professional rights in private primary schools and middle schools in Huaihua City are not protected sufficiently and the teachers' living quality is rather low. The result indicates the teachers' rights for education, research, guiding andevaluating students, pays, democratic management and training are violated to a different extent, especially rights for education, pays, democratic management and training, which results in the teachers' low sense of security, high pressure in spirit and work, reluctance of teaching in those schools for a long time. Thus, the group of teachers in those schools is not stable and the whole quality can't be improved. As a result, our country's continuous development of private education and private schools has been affected.The third part analyses the five causes for violating the teachers' professional rights: partial knowledge;powerless legal support and help;obscure bounds of government's administration, poor management capability and unsound social protection system;imperfect school organization, unscientific school management, unstable group of teachers, and backward condition for running schools;untrue media report and superficial educational study. The article puts emphasis on the third point.The final part suggests taking efficient measures from the point of knowledge, law, government, school and society to really protect the teachers' legal rights in private primary schools and middle schools With a capable and vigorous group of teachers, those schools can improve our country's educational quality and cultivate more qualified students.
