The article begins with the comparison of the development histories of the private higher education policy in both American and China.Then referring to their respective historic contributions rate to their country. Then discuss and compare the two government's policy approaching to the private higher education, which include making of laws and regulations of the goverment, Giving the financial aid and tax policy to the private colleges, Compare the administration of the goverments and educational intermediary institutions.Taking the policy problems and the American experience into consideration, Finally, the article puts forward to some suggestions on private higher education in China. First of all, Building perfect laws and statutes system to ensure the legal equal situation of the private higher education.. Secondly, Carrying out democratic and high-effective administrative system and perfecting supervision appraises mechanism. Thirdly, Ascertaining the government preferential tax treatment to private university;Fourthly, Enlarging the government direct subsidy to private university;Finally,Cultivating nonprofit organization of society to expand societal forces, promoting to build civil society.
