To Analyze The Guarantee Of Education Right To Migrant Worker's Children

The right of being teaching is awarded by the Constitution. The 46th Article of the Constitution formulates, the people has right and duty of education in the People's Republic of China. The nation makes the youth, teenagers and children to develop in an all-around way to cultivate the morality, intelligence, etc. The Constitution right is the people's fundamental right and provides the right of the common laws. Being the education right of the Constitution, the common content must be executed in common laws, like'The Law of Compulsory Education','The Law of Education','The Law of the Protection of Juveniles'right, etc. However, the right to be educated is not independent, which is based on the protect of the whole system of rights and obligations and the advancing of society. With the reform and opening up, the migrant workers contributed a lot to our society and economy. However, their lawful rights were difficult to be protected fully in the old times as a few of shortcomings existed in the old society system. The problem of how to fulfill of migrant workers'children's right to education has a wide concern. This would be not only part of the justice of the society and also about a enhancement of labors' quality. This article focuses on the children of migrant workers'right to education undertake a situation analysis, the use of large amounts of data on the children of migrant workers affected by the stage of education, especially compulsory education phase problems and difficulties of rendering and analysis and from social concerns, school construction, home literacy environment and their four children of migrant workers analyzed the reasons for the difficulties in the city school. The author thinks that migrant worker children's teaching right must be realized at least by four elements,and they are to perfect the government's manager rules and policy-oriented, to extend the protecting area of laws, to carry forward harmonious social climate, and to intensify the guide of education.
