On The Problems And Perfection Of Community Correction System In China

For our country, the community correction system is a new way of penalty execution.It is the relative relationship between imprisonment correction, It means that place theoffenders who compliance the community corrections to the community, with the specialnational law enforcement agencies, and the relevant social groups and non-governmentalorganizations and the social volunteers, in the judgment, ruling or decision within thespecified time, correct their criminal psychology and behavior habits, and promote theirreturning to the society smoothly. It mainly includes six characteristics, namely thecriminal sanctions, the non imprisonment, community participation, ease of punitive,specific object, direct education. Its theoretical basis are five main models, namely thepenalty of restraining principle, the economic theory, the socialization theory, labelingtheory, the theory of criminal policy. It has three big social value, which is conducive tothe criminals back to society; improves the quality of rehabilitation; help to alleviateovercrowding of the prison and reduces its cost.Nowadays there are three main problems in our community correction. First, thelegislation of the community correction lags behind, including the legislation is notperfect, the applicable object is not wide, the reward and punishment measures is notperfect. Second, the work of community correction mechanism is not perfect, includinglacking of specialized agencies and workers in community correction, lacking of financialsecurity, lacking of oversight mechanisms; Third, the community correction cultureproblems, including the lack of community identity, which restricted the development ofcommunity correction; the social public lack of awareness of community correction.Improving the system of community correction can follow the following threeaspects. First, perfecting the community correction legislation, including the legislativeprinciple, legislative mode and revising the criminal law and criminal procedure law toimprove the status of community correction punishment in the penalty system. Second,establish perfect community correction mechanism, including the strengthening ofcommunity correction team to improve the service level, the establishment of community correction of financial funds ensuring system; establishing a scientific and reasonablecommunity correction system to improve the quality of the correction, innovating thecommunity forms, improving the oversight of the community correction. Third, strengthenthe construction of the community and change the idea of execution, includingstrengthening the community construction, to provide a sound basis for communitycorrection; change the execution of punishment idea.
