Quantitative “Rule Of Law” :A Study From The Worldwide Governance Indicators

The practical experience of comprehensive and special assessment of rule of law in the country shows that the quantification of rule of law may become a new impetus to the reform and development of the rule of law.Under the social background of promoting the rule of law comprehensively,to establish a scientific assessment system and standard of the rule of law is of great significance.Due to the late start of China's rule of law index assessment,with the continuing development of practice, the problem from the rule of law index in the theory and practice is increasingly becoming the focus of the academic community.Therefore, this thesis will analyze the theoretical background of the assessment of the rule of law in China from the perspective of the reconstruction of rule of law assessment culture, the sociology of knowledge and the intangible assets of the state.In order to make a case study for the rule of law index in Worldwide Governance Indicators,this paper will trace the "original" content and its practice evolution.After the empirical analysis of the path selection and assessment method of the rule of law index, the improvement direction of the rule of law index is analyzed.In addition to its introduction and conclusion, the thesis is divided into five parts:The first part is a brief review of the history of jurisprudence, and give a further interpretation on with the profound connotation and cultural background.In that case,the attempt is to add importance to the quantitative study of "rule of law",which will reconstruct assessment words,realize the spirit as well as stimulate the experience study of rule of law.The second part points out the background of the birth of "rule of law" from the perspective of Sociology of knowledge,trying to explain that the rule of law index in China is the inevitable trend of the development of the times.At the same time, it reviews the domestic situation of academic research on the rule of law index, which presents there trends : research for the local assessment theory of rule of law and the local practice of the rule of law index are relatively mature; establishing the rule of law index in China context attracts much attention;the special assessment of the rule of law index is favorable.The third part is starting with the rule of law index of worldwide governance indicators, trying to explore the important role which the rule of law plays as the intangible assets in the increment of the wealth of nations,then a comprehensive analysis on the concept of quantitative "rule of law" in the Worldwide Governance Indicators,and on the basis of this,the statistical method of the "unobserved components model" of the rule of law index in worldwide governance indicators is dissected.The fourth part has given a rational review on critical and responsive view that is contained in the rule of law index in worldwide governance indicators,which is a basis for further comprehensive interpretation of the logical structure of the rule of law index in the worldwide governance indicators.The fifth part returns to the reflection level of the assessment path of the rule of law index in China.Having comprehensively analyzed the logical starting point of the rule of law index in worldwide governance indicators, this thesis, combining with the specific practice of rule of law index assessment,will explain the assessment path in four dimensions: "reference function", "context understand and use", "assessment subject is neutrality and data available is from a variety of sources", "accept public review and supervision",and at last put forward some advice for the future path selection.
