The Researches On The Standardization Of The Implementation Of Shanghai Housing And Land Resources System's Administrative Licensing

The enactment of the Administrative Licensing Law (ALL) is of much significance to the construction of administrative law in China, and has made many important reforms and improvement to the present administration licensing system. As the department in charge, Shanghai Housing and Land Resources System has encountered many new situations and new questions. So it's necessary to study how to standardize the implementation.First, the thesis analyzes the general situation of the ALL implementation. In the last few years, 3 reorganizations have been carried out to optimize the administrative licensing and proceeding of operation. Analyze the present implementation of administrative licensing of civic bureaus and district bureaus that are parts of the system in detail. The implementation of administrative licensing is socially and highly effective.Second, diagnose the reasons why the standardization is insufficient in the process of the implementation: the administrative idea has not radically changed, enactment of administrative licensing hasn't been exactly defined, the process of administrative licensing is difficult to put into operation, supervision is insufficient.Third, as ALL is an important law which relates to the transformation of government's function, reform of administration system, development of national economy, consummation of market economy and the authority of citizens, we should take a long view of the effect of it. As far as it goes in recent years, at present the implementation of administrative licensing is developing in 4 directions: more informatized, more human-friendly, more efficient, more efficiently supervised.Finally, we must take the following measure: reform the administrative idea, improve the legal system, set up 5 basic operational principles, create and improve supervision system, establish administrative system.
