Deviation From System About The Collective Forest Right Reform

Since 2003, the rural collective forest right system reform had been started in four provinces, then fully reformation had been implemented in most of China, and now the reformation about the rural collective forest right system has been under orderly and in full swing implementation. Implementing the rural collective forest right system reform, the state intends to improve forestry income of peasants, especially these forest-dependent peasants, strengthen ecological construction and maintain ecological security, promote harmony, stability and development in the rural society. However, it is value to investigate and research whether the practice of reform is reached the system design or not.From the reformation in village L in the central region of Jiangxi province, the rural collective forest right system reform, imitating land contracted responsibility system reform, did not achieve the same effect with the former. It didn't achieve as immediate effectiveness in economic, social and ecological areas and so on, as the publicity by the news media. In other words, the practice of reform is in a serious departure from the original intention of system design. To analyze the reason, the author considers that there are four main aspects. Firstly, forest right in public property is different from land property in private property, thus the collective forest right reform can't completely imitate the land contracted responsibility system reform. Secondly, in the trend of conservative rural habits and market-oriented power of pursuing their own maximize interests, peasants usually choose some behaviors against the original intention of ecological protection. Thirdly, neither a full and clear property rights nor collective protection of the forest, the tragedy of the commons would be certain to happen. Fourthly, forest right system reform is really a major "social engineering" that the state integrates forestry resources. Inevitably, there are some abuses that local knowledge and living habits of peasants are ignored.This paper mainly aims at the body of forest right system reformation. The paper, which primarily investigates the practice of collective forest right system reform in the specific village, using different research methods such as interview research, case analysis, literature research and so on, standing on the position of national ecological safety and the rural social development, attempts to analyze the practice results of collective forest right system reform and explain their reasons from multiple perspectives. These make the paper more realistic and valuable.
