The Research On Risk Factors Analysis And Control Of The Current House Trading Contract Template

Currently, the real estate market in China is still in a seller's priority. The house sellers are in a relatively strong position since they have more relevant information about the real estates than the customers. Consequentially, the sellers use this information asymmetry to constitute a series of unfair rules on the house trading to aggrieve customers'legitimate rights and undermine the fairness and justice.One reason for the customers'weak position lies in that"house trading contract template"has bugs itself. The other is that the customers cannot identify the risks of the whole trading process. As a result, firstly, this thesis made an overall analysis on the"house trading contract template"and identified nine major risk factors of the"model text": land usufruct, pricing and size difference mitigation, the allocation of rights and obligations, the designing change, the house delivery, the house quality, the property right of the house, the house servicing and the ownership of the public areas. These factors were identified by combining with the problems which the customers often meet in the house trading process based on the risk factor identification principles and the methods of the risk management. Then a questionnaire was designed considering the risk factors existing in the"model text". Based on the data processing of the redemptory questionnaires, a risk assessment model was developed by statistics methods. Meanwhile, it concluded that the total risk of the current"house trading contract template"was on the high risk level by quantitative calculation and grading the risks. Finally, the house trading process was divided into three stages, the stages before, when and after the contract was signed. The risk factors of each stage were analyzed and the corresponding risk control measures and strategies were proposed.The purposes of this thesis is to find out effective methods and strategies to control the risks of the"model text"and house trading by analyzing the risk factors of the"model text"and house trading process. It also helps the relevant governmental departments to pay attention to the risk of the"house trading contract template"and makes ordinary customers have further understanding on the risks of the"model text"in order to improve their risk consciousness and self-awareness of rights.
