A Study On The Problem Of Rural Land Nationalization In China

Since the reform and opening-up, the collective ownership system of rural land has gotten prominent achievement. But during the process of the rural reform, more and more problems emerge. The reasons are the inhere drawbacks of collective ownership system of rural land and the dual land system and dual land market between city and country. This paper points out that the rural land nationalization is the optimal option for the solution of these problems and the innovation of rural land property right system in China. Rural land nationalization can promote the efficient using of rural land resource , protect the land rights of farmers, change the dual structure between city and country, ensure both urban and suburban areas grow simultaneously and boost harmonious development of economy and society. Rural land nationalization can lay fundament for the construction of the well-off society and socialist harmonious society.This paper bases on the situation of our country, follows the guideline of Karl Max's land property rights theory and uses the findings of western property rights economics and domestic scholars for reference. It reviews the transformation of rural land property rights system and the formation of the dual land system between city and country in China. Then, the paper concentrates on the problems and the reasons of the collective ownership system of rural land , emphasizes the dual land system that city land belongs to nation and the rural land belongs to collectivity is the important reason of the abruption between city and country and the invasion of farmers' land rights. So it is necessary to nationalize the rural land , let the nation hold the ownership of rural land, provide farmers the long-term stable land use-right that can circulate as real right and unify the land system. In the end, the paper puts forth the rules, guidelines, system arrangement and blue print of rural land nationalization.
