A Study On Protecting The Rights And Interests Of Farmers Whose Land Was Expropriaed

With the acceleration of urban sprawl and industrialization, A huge mass of collective land in the countryside has been expropriated ,which produced a new vulnerable group of people -the farmers who have lost their land and the number is growing. The farmers have lost a lot of rights and interests as a result of the loss of the land, thus that will cause many social problems and affect the stability of our society if it cannot be dealt with successfully. How to solve the problem of the farmers' loss of land reasonably has been focused on by many scholars and experts, for it is not only the wish of Government but also the urgent claim of the massive farmers, what's more, it can lay a good foundation for urban sprawl and the steady development of economics and give an example to other countries on how to settle such problems.This article used the theory of urban sprawl ,the theory of ground rent and the theory of social security as its basis, took the methods of the qualitative analysis ,quantitative analysis and normative analysis .It elaborated on the current conditions of farmers who lost their land in many ways such as the possessed land area of those farmers, the compensations of the loss of land, their employment ,income, living and social security by obtaining data from cyberspace and on- the- spot research. Then the author came to the conclusion by summarizing and full analyzing the problems such as the low-paid compensations of the levied land, the singleness of means of compensations ,many difficulties in the farmers' reemployment, the ill-informed background ,the bad management and misuse of compensation fund. The author held the opinion that the expropriating system of land is the root of the farmer's loss of rights and interests, and at the same time those farmers have no access to the equal social security which is open to citizens. The low accomplishment of the farmers and the high competition of the employment market conspired the difficulties in their reemployment. The thesis drew a lesson from the successful measures taken domestically and abroad to protect the rights and interests of those farmers and put forth some suggestions :consummate the system of expropriating land, ensuring the reasonable and timely distributing among farmers of the compensation fund, complete and consummate the social security system to benefit the farmers, improve the reemployment of the farmers, rectify the procedure of expropriating the rural land and set up the supervision mechanism ,promote the construction of legal and democratic system in the rural area.
