At present,China is actively building new rural areas,to increase agricultural Huinong strong efforts to promote good and fast social and economic development;at the same time,local governments are competing to increase investment,so that the phenomenon that illegal occupation of arable land and deductions arrears of land requisition compensation occur repeatedly.The Government and the public are going for profit,resulting in increasing the relative poverty of landless farmers and mechanism for the coexistence of blood transfusion and blood.At the same time,global food crisis,China's cultivated land protection posed a severe challenge. Financial crisis,seriously threaten the real economy,increasing the risk of the national economy going down.The prompt start of the broad masses of the rural consumer market is needed,and time waits for no man.Whether it is to build a harmonious society,or start the rural consumer market, the premise and the end result is to effectively protect the interests of farmers.Therefore,it is necessary to do everything possible to enable farmers to get rich.The current land requisition and compensation system is a competition for profits,so it must be innovatted and improved. Including introduction,the paper is divided into six parts:In introduction part,the background and significance of innovation land requisition system is introduced first,then,a detailed analysis of the Taiwan region of China and foreign content of the land requisition and compensation system,the assumption of this study involved a number of important concepts,and displaying a summary of the domestic scholars' efforts in the field.The second part is on theoretical research.Analysis of the rationale for the rent of land,the new institutional economics theory,theory of a harmonious balance,the principal-agent theory,and systems theory are introduced.The land requisition and compensation theory and the content of China's agricultural land prices are also analyzed,pointing out the reasonableness of the existing levy of compensation of agricultural land prices,raising the concept of complete requisition and compensation of agricultural land prices,and analyzing its contents.In the third part,comprehensive analysis of the defects of China's current system of land requisition and compensation of is made,for example, the defination of the public interest is unscientific,land compensation procedures is unreasonable,the standard of compensation is low,the scope of compensation is narrow,land acquisition judicial relief lacks,the way of compensation and resettlement is single and so on,Then its adverse effects is discussed.PartⅣanalyzes system environment of land requisition and compensation system,and points out that the traditional distribution of ideas,public ownership of collective land,multi-level management system, GDP cadre appraisal system,the Government and farmers ambiguous role of rational choice are deep-seated causes of the problems about a series of land requisition compensation system.PartⅤexplores the institutional innovation of agricultural land requisition and compensation.First,the study analyzes the reasons for institutional innovation and the basic ideas of innovation.To land acquisition for the public interest,land acquisition procedures should be improved and the scope of compensation should be expanded to allow landless farmers to share value-added revenue generated while farmer' land is to be used for construction.For benifits,we rely on the stock of urban state-owned land,and open rural collective non-agricultural construction land transfer market in the framework of property law,setting aside the demands of clarity in the collective land.When we used farmer' land for construction,the construction land-use rights replace contractual right,and the ownership of farmer' land still keeps unchangable. Collective land-use rights is only a right in the flow.Farmers enter with their own "usufructuary property right-the right to contract for the operation".Under strict guidelines of the annual land use plans and regional planning of urban and rural areas,and in the framework of laws and regulations,farmers and non-public land units negotiate about the value of their own land.Then paper focuses the basis of farmers.' sharing the added value of agricultural land.At last,paper talks about how to optimize the platform system environment of land requisition and compensation system.In partⅥ,paper selects counties in Luoyang as an example,measures the amount of land requisition and compensation,basing on the above analysis and farmers' sharing value-added revenue of agricultural land,and proves the result reasonable.
