Research Of Transference Of Rural Land Contraction And Management Right In The Counties Of Heilongjiang Province

The issue of agriculture, rural areas and peasants is the land in the essence. To implement the policies of the party, the policies of the land should comes the first. Secure the transference of the land contract and management land is the key to complete the system of the land contract and management right. The important status of the system of land contract and management right decides the importance of the research of the transference of the land contract and management land. In recent years, as the development of the agricultural economy and small town construction, the transference of the land contract and management land becomes more active. On the precondition of long and stable implement the policy of making the family contract as the basic form and double system management, it is necessary to build the system of transference of the land contract and management land. It concerns the agriculture development, peasants'interest and the rural stability. This paper mainly discusses the methods to speed up transference of the land contract and management land through a research on the transference of the land contract and management right and realize the effectively running of the transference of the land contract and management land the scale management and promote agriculture production efficiency.This paper first distinguishes the concepts of the right of land contract and management and introduces the main methods of transference of land contract and management right. It will also discusses the problems of transference of land contract and management right in the counties in HeiLongJiang province as the basis of some theories such as district location theory, land utilization in large scale theory, utilize land concentrate and economically theory, the rule of land reward reducing, and land protection theory. It introduces some methods, the goals achieved and the real practices. Next, this paper introduces several problems existed in the contents of transference form and conditions together with the basic condition and features of transference in the villages in the counties in Heilongjiang province and then raises the main strategies to speed up transference of land contract and management right in the counties in HeiLongJiang province. At last it gives an example of Yilan county to analyze the current situation, basic thoughts and methods.This result of this research indicates that:in the process of rural land transference, there are lots of new situations and problems. As there is no corresponded save methods, law-making should gibe protection of both sides of the transference. If we want to make the right of land management right and ownership run, we must insist the main direction of "the ownership of the community, the contract right of the peasants and the use right of transference." The reformation of land transference system should consider the land of the villages as the center of land transference. To realize the large-scale management, we should enhance the aids towards agricultural production. We should emphasis on the publication of the policies of land transference, the market construction and the circulation as well as shorten the distance between production and sales. This paper adopts the research of both definition and quantity analysis, together with giving the concrete examples. On the basis of the policy, laws and social conditions, together with the features in location, this paper chooses the transference of land contract and management right in the counties in Heilongjiang province as the topic which can reflect the peasants'interests best, and give complete advices in the main subject, the system construction and ways of transference.
