The Study On Constructing A Government Under The Rules Of Law

A government under rules of law is the government type in the transition period of China which is under the process of construction. Law thoughts during the ancient Greece, Confucianism, principle of constitutionalism, rule of law theories in Marxism, and western public administration theory are the basis of our country for constructing the government under rules of law. And the constructive legal government will have a positive influence on the socialist market economy, CCP's position of the party's holding power, the construction of service-oriented government and the realization of harmonious society. From theory to practice, the legal government in China has experienced three periods: theoretical preparation, establishment of target, and transitional period of mode. Through the rethinking and review of our country's legal government constructive process, it can be concluded as three aspects: balanced configuration of interest, balance of right and power, and the harmony between the government and citizens. These are not only the critical factors of the construction of our legal government, but also the standard of whether the legal government has been established.Nowadays, problems in the construction of legal government are: serious situation of the official standard thought, imperfection of the legal system, government information is difficult to be announced to the public, administrative supervision is formalized, rights are pressed by power and so on, and the problems in practice shall be resolved in the theoretical investigation. Through the investigation of the three dynamical mode of the construction of legal government: government-oriented model, citizen-promotion mode and positive interactivity mode, it can be seen that we shall establish the legal government mode of positive interactivity mode.In the end, this paper also makes the feasibility study of the global government reengineering movement, socialist market economy development and the nature of people in charge of the country in socialistic country, constitutional guarantee and the attitude of the above ruling class, and the premise to build positive legal government in China, this paper deduces the specific thoughts and routes to build the government under the rules of law with the model of a positive interactive .
