The Responsibility Of Government In Rural Land Circulation

Since the1978, the transfer of rural land has been in existence, and the state's policy on rural land is consistent, supported and allowed.The transfer of rural land mainly refers to the transfer of land contract and management rights,Rural residential land use right in the collective construction land used right ,in China. At present, China clearly defined policies and laws to allow the rural land contract and management rights transfer.Rural residential land transfer is still not permitted, but the law does not prohibit . For the collective construction land use right, our policies and laws is conditional license.This paper studies the right to transfer land contract and management of rural residential land .This paper introduceds the report on rural land and the basic theory of government.And then defines the object of study of this rural land transfer and government responsibilities ; This paper analysis of the reasons for China's rural land and significance and proposeds the problems in the absence of governmental responsibilities.Finally, China's rural land circulation of governmental responsibilities is important . This article is divided into three parts.The first part is the basic theory. This part of the content and features come from the basic knowledge .It analysis of China's rural land-related laws and policies,and a brief on rural land, government management of content and systems.The second part analysis the current situation of China's rural land and the existing problems and cause .Rural Land and achieved certain results.There are lot of transfer methods, such as transfer, subcontract, lease housing sites, but also many problems, especially in rural land issues in the absence of governmental responsibilities and the government deviated from the rural public services and governmental organizations to guide the intermediary market imperfections,rural land market, the lack of support services.The third part is the most important,.It cleares and improves the rural land circulation in the governmental responsibilities and focuses on functions from the perspective of solving the problems of land transfer to address the problem of lack of governmental responsibilities.Rural land in the governmental responsibilities include what development of rural land in the guiding ideology and basic principles,improving the rural land contract and management rights management system,establishing the rural land market mechanism and strengthening the rural land contracting right service support system ;the protection of national land and food security.This article reference in the theory and practice of reading-related cases.
