Research On Off-home Worker Backflows From A Perspective Of Labor Property Right

After reform and opening-up, the process of modernization and urbanization is growing, a lot of surplus rural labor force transfers to work in cities and township enterprises, forming a special social group of rural migrant workers. The rural migrant workers make significant contributions to urban prosperity and national modernization, but they never enjoy national treatment, resulting in off-farm worker backflows. This paper is guided by a series of important thoughts, namely Marxism-Leninism, Maoism, the Dengxiaoping Theory and the "Three Representatives", and the paper analyze the special phenomenon of "off-home worker backflow" through the thoery of labor force property right.The paper is divided into four parts:The first chapter generalizes the current study situation of "off-farm backflows". It introduces the theory of "off-farm backflows" from examples of the push and pull theory of population transfer and Todaro's theoretical model about Rural-Urban Migration, and it reviews and analyzes off-farm backflows'historical stages, features of rural worker's human resources, features of migrant workers returning home to self-employment, and its impacts and limitations. Through the analysis, the author puts forward further discussed questions which includes migrant workers'legal rights, the relationship between China's modernization and industrialization and research on rural labor workers returning home and other relevant policies.The second chapter analyzes the concepts of labor force property right, labor force property right, owned by labor owners during the market dealing, is made up by ownership of labor force, use right, allocation right, earning right and others. It is a bundle of rights which include rights of ownship, usage, allocation, profits and development. labor force property right has its significant features:dependent, indivisible and flexible used by migrant workers. Rural migrant workers in cities are the vital part to our industrial workers, so it has important meaning to ensure their labor force property right which can motivate them to construct socialism and safeguard they can enjoy socialism's developing results.The third chapter focuses on analyzing the causes of phenomenon about labor property right. The vacancy of labor property right is the pulling force of off-farm worker backflows whose manifestations of property right's vacancy of rural migrant workers is rural worker's unequal salary, unequal employment chance, unfair educational opportunity and social safety. And the causes are irrational household registration system, imperfect labor market, labor's low self-quality and weak consciousness property right. Property right in place of rural migrant workers in cities can improve workers' internal need for self-development, be the natural demand of constructing a harmonious society and create advantageous conditions for workers returning home in order.The fourth chapter indicates the policies of rural migrant worker backflow and protecting rural worker's property right. Rural migrant worker backflow is good for developing economy in rural areas, and it is an effective way to realize rural workers' property right. However, rural migrant worker backflow to self-employment is a derivative" phenomenon from rural workers entering cities for jobs. Entering cities for jobs is the basis because if they don't enter cities for jobs, they will not be related to back home for self-employment. So our government should carry out macro measures to protect rural workers' labor property, safeguard them various legal rights, create good systems for their returning home for self-employment. Local governments where happens the off-farm worker backflows should take specific measures, enhance its service function, create a good environment for self-employment of rural workers, attract outstanding rural workers and then promote off-farm worker backflows orderly.
