Text Of Chinese Patent Application Claims The English Translation Of The Book Discussed

This paper is a study on the normal Chinese-English translation of Chinese drug patent text.And the normal English translation of a number of expression and professional terminology,which are in the Chinese drug patent text are formed in this paper.The study is in the situation of that there is no research on the translation of Chinese drug patent text, referring to the existing study on the Chinese-English translation of the patent text and the Chinese drug.The study is carried on in order to respect the traditional knowledge and process technology of Chinese medicine,and to express the legal meaning of the text accurately.To achieve the study on the normal English translation of the Chinese drug patent text in this thesis,mainly law case summary,case analysis and literature study method and other methods are used in this research.Through case summary method,looking up 296 authorized Chinese patent cases which are applied between 2002-2005,summing up the Chinese expression usually used according to the product theme,the theme of processes and the theme of use.Then deeply analyzing the legal meaning of the Chinese expression, and summarizing and classifying the Chinese expression in the accordance with the legal meaning.The Chinese expression and the professional terminology to be researched on are sorted up thereby.Through case analysis method,11 PCT international patent application texts in Chinese medicine inspection are looked up,sorting out the existing English translation of the commonly used expression and professional terminology in the claims,as well as the foreign examiner's examination aimed at the mistake of the English translation of the text and the responses of our lawyers.On this basis,through the literature study method(looking up the Chinese-English dictionary and referring to the existing translation in patent text),to write down the English translation of the professional terminology and expression in the first part and the characteristic part according to the product theme,the theme of processes(which contains the preparation processes and the quality testing processes) and the theme of use separately.Through the literature study method(looking up the "Merriam Webster","Oxford Advanced learner's English-Chinese Dictionary","the Latest Medicine English-Chinese Dictionary",and the book of pharmaceutical English,etc.) and the case analysis method(If the typical cases are involved,the foreign examiner's examination would be referred to),the English words and the phrases involved are determined by their English concept with the precondition of that the legal meaning must be expressed as exactly as possible.And on this basis,the further studies on the translation for the Chinese expression are carried on in accordance with the English habit.Through these studies,the normal English translation for a number of expressions and professional terminologies in Chinese drug patent text are determined firstly.As the basis of the international Chinese drug patent application,a number of normal English translations which are used in the English text are necessary to be determined.So as to supply the language insurance for the smooth progress of the international applications of Chinese drug patents,as well as to maintain the right of authorized patent. The study on the normal English translation of the Chinese drug patent text in this paper is the valuably useful English expressions and professional terms which are aimed at the feature of Chinese drug patent text.The use and of these normal translations will supply the reference for the persons in the art,and can provide further in-depth lay the foundation for research.
