As a result of the development of socialist legal system and the further improvement of higher education system reformation, governing schools by law and constructing harmonious campus have been the important content and goal in the process of higher education system reformation. Education Act and Higher Educational Law state clearly that colleges and universities have rights to operate autonomously according to law and administer independently according to regulations. Schools have rights to make regulations to restrain the behaviors of college students with the purpose of achieving education aims; however, as the citizens with independent individual and consciousness, college students enjoy not only basic rights under the constitution equally with other citizens, but also special rights for special identity. Therefore how to balance between tertiary rights and college students'rights and how to make college students enjoy the rights of their own are focused on by many educationalists and college students.However, during the processes of drawing up and carrying out of the college regulations, their impartiality, right procedure, rationality, legality and legitimate rights and interests of students are usually neglected. Based on empirical analyses to college regulations, this thesis points out the current situation of the rights and interests of college students, analyzes the path to construct rule of law to college, and explores the basic ways to protect the rights and interests of college students.This thesis makes a study on the protection for the legitimate rights and interests of students in four chapters.The first chapter gives a definition to the concepts related to rule of law to college and protection for the legitimate rights and interests of students and analyzes the types of rights and interests of students, the legal basis for tertiary rules, and the relationship between college regulations and the protection for rights and interests of students. The second chapter focuses on the current situation of protection for the rights and interests of students and makes a case study on the current situation of violating students'rights to be educated, health rights, property rights, right of reputation and privacy, then analyzes them from the aspect of law. Chapter three tries to find out main reasons for damaging the rights and interests of college students from the perspective of conception of law, the system of college regulations, the way to relieve students and supervision system. The forth chapter puts emphasis on strengthening rule of law to college and the basic ways to protect the rights and interests of students, then proposes writer's opinion and suggestions from the aspects of establishing the conception of administrating schools by law and constructing the system of college regulations.
