At present, the application of transgenic technology is mainly in the field of agricultural production, and the Commercialcultivation of genetically modified crops bring out insufficient light for human being to solve the world’s food problems. At the same time, due to lack of sufficient scientific evidence, the safety of genetically modified food are questioned by experts and the public, and the disputes about the security never quit.After gaining some understanding through the overview of genetically modified food safety, the thesis focuses on genetically modified food. Food safety means people’s livelihood and social stability, and genetically modified food is showing the growing trend to replace traditional food, so the government has to try to ensure the safety of genetically modified food, and avoid the threat to public health due to the uncertain risk hidden behind. Therefore, state should reflect its security function, and establish a perfect legal system to avoid the potential risk of genetically modified food, which is also the purpose of this thesis. With the introduction of the current situation of the legislation in China, we can find out that in recent years, our country pays more attention to the safety regulation of genetically modified food, but the current legislative situation is still worrying, needs to be improved. So this thesis will provide train of thought for genetically modified food safety legal system in China through the introduction to the European Union, the United States, Japan and relevant international legislation. And, it will find legal basis for genetically modified food safety legislation in the field of jurisprudence, economic law, administrative law and international law. Finally, through the introduction of foreign legislation, use for reference and make a choice, in order to perfect the genetically modified food safety legal system, it will propose feasible methods to build our country’s system, and establish strict legislation pattern, take the precautionary principle and transparent principle as the basic principles, set up access system, safety assessment system, license system, labeling system, social supervision system, remedy system and so on.
