Since 1980s, a great social reform has been coming into being in our country, whichaccompanies profound transformations in the realms of politics, economics and culture, etc.Most of all, after the overall modulation and renovation of the social structure, somesubstantial new changes has come with the social relations, the authority and reason of thelaw being the preferred ways to adjust and balance the various social benefits, and the wholesociety stepping into the transformation era. With the programming system being broken up,the government is not any more the omnipotent dominate of the society, but the provider andindemnitor of the social services, naturally stepping out of the monopolization of the socialresources and the rigorous control of the space for private operations. Thus comes the spacingbetween the government, the society and the market, which will cause the various socialorganizations to speed up and scale up, for sure. The springing up of the social organizationsmeans not only the resume of the right to organize at liberty, one of the basic constitutionalrights, but also the arousal of consciousness with autonomy, which is demanded by a citizenlysociety itself. And furthermore, it is surely one of the important features of a law-basedcivilization. The occurrence and development of the social organizations during thetransformation era in our country has broadened the territories for autonomy in the realisticallife, and has made up the field in which the governmental power yield for the social reform.On the other hand, this has brought impact on the traditional law scheme, theory of main bodyand the social mudulation system. So in answer to the various social conflicts caused by thesocial organizations, it is of great significance to fully perceive and apprehend the historicaland changing process of the occurrence and development of the social organizations, to welland truly grasp the representative features of the social organizations in our country and toeffectively regulate the social organizations by means of law, of course all being establishedin the realistical background of the social transformation era.This thesis is to expound the basic theory on the occurrence of the social organizations from the two points of view:the basic constitutional rights and the citizenly society, comparing and analyzing the historical changes of the social organizations in both China andwestern countries, summing up the representative features of the social organizations for this phase in our country—a dual nature of government vs. folks, and putting forward the corresponding countermeasures against the regulation and affirmationg of the main body qualification of the social organizations and against the lawful establishment about their activities, funding operations, internal unfair rivals and monopoly risks. Although the social organizations in our courtry are not developing in a large scale and are not exerting the same profound impact on the realistical life as in the western countries, the development of autonomy for the citizen, as one of the features of the modern nomocracy, can not be avoided or ignored. With the reform in our country entering into a crucial phase and the citizen demanding new functions of the government, the social organizations are playing more important role based on the option of "stronger government and stronger society". No doubt that the necessary lawful regulation of the social organizations will help keep them growing better and exert themselves to ensure the healthy and steady development of our society in future.
