The Limits Of National Relief

The purpose of the traditional relief measure of our country was to maintainsocial stability through strengthening the management of urban vagrants, whichwas mainly for the interests of urban inhabitants and reflected the "politicalcontrolling" of the state. However, this kind of mechanism from above to belowhad an obvious defidency that it ignored the urban vagrants' self-awareness andlacked necessary interaction between the state and the citizens and the relief wasregarded as almsgiving by the state, notwithstanding it played a positive role in thebeginning period of our country.People pay morn and morn attention to their own fights along witheconomical development in modem society. Human rights have been respectedand ensured by most of the country all over the world and have been explicitlystipulated in People's Republic of China. Although people have been questioningthe rationality of traditional relief measure, until the "Sun Zhigang event" the rightsof urban vagrants have not been highly valued. The subsequent legislation ofRescue Policing Method made progress comparing with the old one, but it did notpay enough attention to the rights of urban vagrants. This dissertation maintainsthat man is a man because of the dignity and reason why urban vagrant should beprotected lies in the idea of"equality". The urban vagrants with "special status"should also have enjoyed the basic human rights. It is reason of the "special status"that make the urban vagrants have priority of"Right to live" over common citizens.The "equal rights" and "dignity rights" complement "Right to live". The latter isthe foundation of former which conversely makes it be meaningful. The primaryobligation of the state which is positive is to make all the citizens survive, and forthis it is necessary for the country to amend the unreasonable roles. Whileemphasizing the protection of rights, this dissertation gives an advice that thecountry should establish systems of city and countryside lowest social security.
