The Primary Government Administrative Barriers And Countermeasures

Administering a country on the basis of legal system is becoming a common knowledge for the modern democratic countries. Administering the country on the basis of legal system, and establishing the socialistic legal system, is the key target of our socialistic modernization. This policy is added to the Amendment of the Constitution. It takes legal government management as its crucial basis and key point. Since the end of 1980's when our country has set up the concept of legal government management, we have certain achievements. However, various obstacles have been uncovering increasingly, which seriously delayed the processing of legal government management.This study starts from the obstacles of the legal government management, enumerates the objectively existed appearance of the obstacles, analyzes the cause of the obstacles, focuses on the obstacles' features faced by the local government, and proposes the countermeasure to eliminating these obstacles. It shows the objectively existed problem in the execution of the local government through the case of administrative charges from the local Administration for Industry and Commerce.This study considers that, since the local government departments have special position in the administrative structure, they encounter more specific and direct obstacles. This must be seriously regarded, or it may cause the society's agreement crisis with the whole legal administrative system.The reason of the obstacles' occurring and existing is mainly the shortcoming of the legal administration system, the lack of the legal administration atmosphere and the failure to meet the personal requirements of the local government officers. The incompletion of the legal system and the unqualified government officers, which are widely regarded as the obstacles by many scholars are not the main reasons.This study thinks that the elimination of the obstacles for the local government should focus on the establishment of the non- gap government, the inspiration of the government officers, and the supervision of the public opinions, completing and realizing the legal administration. Thus, the construction of the socialistic legal system of the country will come into existence.
