In the process of education, teachers have the power to manage and guide students. Facing with the misconduct of students, if teacher’s advising doesn’t work, the teachers can choose some disciplinary approach to manage students. But whether the teachers have the discipline rights? What kind of discipline rights does the teachers have? Whether the exercise of discipline rights has differences between different countries? This study starts with above-mentioned questions, the article sorts out the theory and practice about the exercise of discipline rights. By using the method of questionnaire and interview survey, the article explores the current use of China’s primary and secondary school teachers’ discipline rights in cognition, mode, frequency, resistance and effect. By the comparative study, the article analyses the experience and lessons in the exercise of foreign teachers’ discipline right and its enlightenment to China. Based on these researches, this study comes to the conclusion that the dissimilation of teacher’s discipline rights have two cases as “abuse” and “deficiency”, at the same time, for our teachers’ discipline rights to realize the standardization and the rationalization, the problems in policy and law, management mechanism and cultural education are urgent to be solved.
