Gender discrimination is an eternal worldwide problem. Women and men, are the mainstay of social development, the creator and owner of human history, but the Sire civilization of 3000 years is not to provide a truly equal competition chance to both genders. Female employment is difficult; female employment is of poor quality; generally speaking, unemployed women occupy the larger proportion of the unemployed; the female re-employment is also difficult; female labor rights issues are highlighted. Therefore, in this context, the paper cards systematically and attempts from the gender analysis perspective to study the vulnerable groups -women as the research subject, who are in the live tremendous changes of the social and interest structure. The paper mainly uses comparative analysis and documentation analysis methods."Gender discrimination" has been the problem concerned in sociology, anthropology and psychology fields. Therefore, in this paper, a number of sociological viewpoints are also introduced. First from the perspective of sociology and economics, some relevant theories on employment gender discrimination of Chinese and western scholars are introduced; then on the basis of integrating multi-perspective viewpoints, the concept of discrimination was defined. On the performance of gender employment discrimination, scholars generally classified it as occupational segregation, non-formal employment and wage discrimination, but in this paper, based on the perspective of human capital, occupational mobility and career life are added. Analyzed from sociology and human capital theory, it is thought that in the process of social transformation, restricted by the traditional concept of gender, the impact of role differences and physical characteristics of women, as well as the negative effects that education discrimination brought to female cultural quality, women are in a state of "natural" disadvantage and employment gender discrimination comes into being. At last, the construction of advanced gender culture and the advocacy of gender temperament diversity are proposed in the paper. It is also pointed out that there are some problems in China's current policies of resolving female employment discrimination, and it is brought forward to further improve and refine existing general concept of current policies and legal provisions. It is questioned about the operation of the forthcoming "Employment Promotion Act" on the anti-gender discrimination regulations and to establish the anti-discrimination legislation package is proposed.
