A Study On The Transfer Of The Right To Use Homestead In Rural Areas

With the development of socialistic market economy, the gap between urban and rural areas will be gradually shortened. Therefore, the system of the usufruct in rural housing land has extremely profound practical significance for the development of rural economy. How to make the transference of the use right of residence base reasonable in the process of the monetization of China becomes an important issue and has aroused widespread concern.as an experimental city, Chengdu explores innovative ways to address this problem. Based on this kind of understanding, this article is divided into four parts.The first part investigates the history.it mainly introduces the rural homestead after the founding of new China and the floor housing system changes. By analysis and comparison, problems do exist with the transfer of the right to the use of the rural house site. This is why we have to explore the Chengdu model.In the second section, it makes a systematic exposition of confirmation of land right.as the primary link in the Chengdu model, it consists of two parts, status and problem.ChapterⅢ is innovative models of the rural land transfer system in Chengdu,and introduces the city within the scope of a wide range innovative models of land transfer system in Chengdu. The last part of this chapter analyzes the issues of Chengdu model.Finally, the fourth part is the focus of discussion in this paper. Based on the practical research, the author try to perfect the Chengdu model from procedure and supervision etc. And in the light of the basic contents of land transfer system establishment, the author makes a discussion on how to strengthen and perfect legislation in this filed.
