An Innovative Study On Rural Law Campaign Of Lower Court

With the further development of reform and opening, we must see the new changes of social contradiction which come from the widening gap between rich and poor and the influence of various ideologies. Especially in the legal consciousness of poor undeveloped areas, many contradictions to avert and settle are urgently required legal intervention, e.g. crime prevention and economic interests mediation, rights disputes, maintenance and damages and marital relationship changes. Meanwhile, the society ruled by law is the request of harmonious society, and also is one of ultimate goal about the current Chinese judicial reform. The basic people's court directly facing the masses as the organization and dissolve the grassroots contradictions, and must be safeguard social equity and justice, maintain public order plays an important utility. The rural law campaign of lower court is the key content of its participation in social management innovation and the self-examination and relocation of its own role. In recent years, the supreme people's court has repeatedly stressed lower court should take the rural law campaign as a priority. Promoting to resolve social contradictions.In the background of constructing basic-level service-oriented government, the lower courts are no longer independent of'small government', but an important part of the service-oriented government. The rural law campaign of lower courts is the lower courts'contribution in implement'the active judicial'and'service'concepts, it contains: legal knowledge preaching, the circuit filing, the circuit court and pay a return visit of judge and case. The service of rural law campaign encapsulates the service concept, contents and service mechanism. The current academy pays more attention to the study on service contents of the circuit court such as rural law campaign than the whole service. The discussion on the lower court's rural law campaign from the perspective of public management is rather scarce. In view of public management, this thesis tries to clear and construct the service by analyzing the theoretical basis and actual difficulties of lower court's rural law campaign, and actual requirements of building a service-oriented government as well. In this paper, the author analysis the relevant data of rural law campaign of Y's court, and find the necessity and possibility of rural law campaign and the actual difficulties and reasons about the rural law campaign service. Finally, ways to perfect the service about lower courts' rural law campaign will be concluded.
