Food safety law of the People's Republic of China, which was promulgated on February 28,2009, is now as a symbol of new stage of the Food Safety Regulation System. In this law,the regulatory authority was explicit set and the regulatory power was divided specifically. The Food safety committee under the state council was fortified as a cooperating agency. The regulatory responsibility system was clearly defined. The status of the Food Safety has taken a favorable turn in the two years.But the hysteresis effect of the regulatory system which can not be ignored is still exists. The principal contradiction of the regulatory system is as before as the regulatory system can not meet the increasing demand of people's food safety. The structural abuse and the lack of regulatory cooperating system have been the main restraining factors of the development of the Food Safety Regulation System.Some western developed countries' Food Safety Regulation System can bring about some useful experience. The experience include more focus on prevention mechanism, more concentration on technical cooperation,more social supervisors included,and so on.The food safety question is not only a forever topic, but also a urgent topic. It concerns social's stability and harmony. In order to keep with the times, the Food Safety System must constantly summarize the experience and lessons, optimize the regulator and improve the regulatory mechanism. The article makes some proposals for optimizing the current Food Safety System from the standpoint of the Economic Law.In addition to the background and conclusions of the topics of this paper, this paper is divided into four parts. The first part is about the general theories of the Food Safety Regulation System. Firstly the conceptions of the Food Safety and the Regulation System are explicit defined. The Food Safety means food's meeting with the demand of people's security requirement, containing no real or potential dangers. The Regulation System is about the set of regulatory authorities and the division of the regulatory power. Secondly, the rationale of the Food Safety Regulatory System is set up from three standpoints including economic basis, sociology basis and law's principle.The second part is to study the current status of domestic Food Safety Regulation system. Firstly the current set of regulator authorities and the division of regulatory power are demonstrated as two graphic shows. Then the structural abuse and the lack of cooperating mechanism are illustrated. In the last, the factors which result the problems are explained.The third part is to find some constructive experience from some western developed countries' Food Safety Regulation system. Firstly the current status of some western foreign countries' Food Safety Regulatory System are described. Three modes are summarized, symbolized as the America model, EU model and Canada model. Lastly, some advice which found on cosmetic fundamental realities of the country are proposed.The fourth part is to table some proposals for optimizing current cosmetic Food Safety Regulatory System. On basis of summaries and references, the proposals can be list as some words:" optimizing the regulatory authorities, integrating regulatory resources, strengthening responsibilities, enhancing technical supports, Prevention priority".
