Study On Legal Mechanisms Of The Back Of Civil Servants

Accountability system originated in modern West was the outcome of western Party System and Parliamentary. After a long period development, it has formed a complete set of operation mechanism and legal system, effectively supervised and restricted the administrative power abusing and promoted the development process of civil society. In China, administrative accountability was implemented in 2003 "SARS" event. From central to local governments it was widespread emerging the accountability system to leaders of administrative organs. It has made a lot of achievements since implementing. However, in recent years, a great number of civil servants were non-standard back after the accountability. That phenomenon aroused the educational circles'and masses'query. Some civil servants are not only reduced levels but promoted and high return after accountability. Most of them chose back in secret, when the situation was without turbulence or forgotten by masses, they changed their appearances and assumed the office of new position. Some of them violating laws and regulations back under disciplinary period, even back in the process of resolving the outburst public events and to the leadership positions again.The first section of this paper defines the basic concepts of back of civil servants, such as "civil servants", "back" and "legal mechanism". In this part also give a brief account of the administrative accountability and administrative supervision relating to the back of civil servants. The second section emphasizes on the analysis of the present situation of China's back of civil servants. It also indicates the defect of China's legal mechanisms of back of civil servants, the present situation of prominent policy provision of Party and the abuse. The third section is on the basis of drawing on the experiences of foreign countries and puts forward to accelerate the work of legislation to laws and regulations of back of civil servants. It also indicates that clarifying every sector of back of civil servants to enhance the maneuverability and unity of legal mechanisms of back of civil servants. The establishment of legal mechanisms of back of civil servants can conceive from two sides: the principles and the concrete system of back of civil servants. The principles are legal back principle, reasonable back principle, open back principle and procedural justice principle. The concrete systems are managing the back of civil servants in category, clarifying the position, requirements and period of back of civil servants. In the last of this paper, it establishes necessary contact of the administrative accountability and supervision and the back of civil servants. It also clarifies the significance of improving the former to improving the legal mechanisms of back of civil servants.
