On Legal Skills Training In The Legal Education Of China

The legal professionalization means legal skills training should become the core of legal education,but current legal education of China has not formed a good set of method about legal skills training, focusing on legal knowledge always plays a dominant role in law school's classroom, and current legal education is seriously lack of legal professional skills training, both of which greatly restricts the quality of legal professionals in China. The scholasticism method , which comes from the civil Law tradition, is the most deeply reason of casuing the said deficiency. However, the scholasticism method is fit for the civil law tradition and has advantages on the systematic transmitter of knowledge on the one hand; but this method also leads to the inefficiency of legal skills training on the other hand, which adapts the legal professionalization with difficulty. Besides, the separation of legal education and legal profession is another important cause. To solve the deficiency of legal education and the separation, Academic circles proposed a lot of points, mainly focusing on the method of Anglo-American, but overall, the effect is not good. Professor He Meihuan's common law teaching method in law school of Tsinghua university is a comprehensively practice of Anglo-American method. This article introduces her practice, analyzes the methods, points out the positive significance on the legal skills training. Especially, she divides legal skills into intelligence skills and practical skills, intelligence skills are trained by law school, and practical skills are by practical circles. This division clarifies the responsibilities on legal skills training between law school and practical circles, which can promote the legal skills training more efficiently and practical. However, her method still encounters great challenge. Summarizing its positive significance and setback, this article tries to propose plan of case-method on legal skills training in China.
