The Study On Legal System Of Public Employment Service In China

China has a large population. This is a matter of great significance to solve the problem of employment for society economy sustainable development and harmonious socialism construction. How to resolve the problem of employment in our country by building perfected public employment service system and corresponding legal system, which is an important subject. This article analysis the general situation about Chinese public employment service, points out some shortcomings on Employment Promotion Act and explores how to construct our legal system of public employment service for building harmonious social labor relations.The first chapter of this thesis is introduction. From the angles of the background of selecting a topic, the raising of questions and the significance of research, it expounds the importance of exploring and constructing our legal system info of public employment service. The second chapter discusses the relation about public employment service and the law of labor market. By comparing the effect of the publicemployment service in Australia, USA and Japan, this paper aims to find out our current limitations in the public employment service and puts forward that its function should change accordingly in the present situation. In order to ensure the smooth development of the public employment service, supporting laws are required to clarify its content and legal liability. In the third chapter, this paper descants on the legal system info of the public employment service. It lists Employment Promotion Law in Sweden, Japan and Germany, and also analyzes the status quo of our legal system info of public employment service dominated by Employment Promotion Law. In particular, this paper focuses on the research on the foundation of legal system info of public employment service. Through the understanding of the employment service right, the function of the employment service and the responsibility of the government, this thesis puts forward the necessity of perfecting the legal system info of public employment service. In the fourth chapter, this thesis advances that the complete system and reasonable management pattern of the public employment service should be established, and gives some constructive suggestions to the constructing of our legal system information of public employment service.The author analyse the present situation and challenges about our legal system information of public employment service in order to better our legal system of public employment service and promote employment. Employment Promotion Act is enacted in order to promote employment, coordination between economic development and employment increase, and harmony and stability of society. However, there are some problems to be further perfected in this law. On the one hand we should promote coordinated development of the social economy and employment by legal ties and active employment policy. We also should adhere to the policy that calls for the worker to find a job on his own, the market to regulate employment and the government to promote job creation. We should do everything possible to expand employment and reemployment and help to basically establish a new type of labor relations.
