A Research On Legal Protection For Citizens' Right To Know

This paper research on the citizen's right to know and it legal systems. First it discusses the concept of citizen right to know, from a social point of view that citizens has right of citizens to know what happened to know and whole community, we interested in this problems and situation, to understand the right to social activities. Secondly this paper study right to know the origin and development, legislative development in the United States and Germany, and the status. This paper discusses our right to know the current status and our citizens right to know the relevant problems. Finally this paper research citizens right to know the problems and related to the interpretation of improvement our citizens right to know, and institutional guarantees and other research.This paper argues that the current problems of citizens have the right to know: our Constitution does not explicitly adopt the "right to know" concept, just stay at the theoretical level, the lack of systematic support for legal documents or the moment the most important criticism; in our country such a lack of rule of law, yet did not form a complete rule of law society, the implied right to information can easily be overlooked; no specific legal right to know the circumstances, many sectors in dealing with the behavior of the implementation of citizens'interests information blockade lack of systematic, comprehensive, and low-rank law, protection is not enough, hardly reflects the fundamental rights as citizens to know the right position. Establish a sound system to ensure citizens'right to know, has become imperative.The problems of right to know in this paper, our first article made clear the constitutional right to know the status of thinking on the concept of legislation, while the need is still thinking in the Legislative technical assistance to build mechanisms for citizens right to know, I think the legislation to strengthen and improve our administration right to know the legal system must be established from the constitution, administrative law, administrative regulations, administrative rules and regulations of the bit-order to clear and complete system of legal norms, and other related facilities to develop and improve the legal system, in the administrative rule of law and rule of law in the context of large practical recognition and protection of our citizens, the administrative right to know. Finally, the article proposed to increase the awareness of public officials, public servants and enhance citizens'right to know the concept, should become the government information disclosure legislation, the administrative protection of citizens'right to know the key legislative goals.
