Currently, new generation of migrant workers has accounted for more than 60% of the total number and the percentage is increasing. Their predicament in employment and survival is a new challenge for social stability in China. All-China Federation of Trade Unions reported,"Appeals and problems of China's new-generation migrant workers have accumulated to such an extent that they have exerted negative influences on China's political and social stability, economic sustainable development, family happiness and personal development. In this case, it is a pressing and prominent issue in a developing country to aim at dealing with problems new generation of migrant workers have confronted with."This thesis selected legal issues that new-generation migrant workers have faced in employment as a research topic. We try to analyze their characteristics and employment predicament and propose to establish and perfect legal environment for their employment so as to promote their employment opportunities.This thesis is mainly based on employment of new-generation migrant workers and laws and regulations related to employment. It aims to conduct some researches on a series of measures adopted to promote their employment and on the following problems. We also construct an initial legal system to protect their legal rights of employment.The first chapter introduces the purposes of this thesis, summarizes the research on new generation of migrant workers at home and abroad and narrates the significance and methodology of this research.The second chapter defines"new generation of migrant workers", analyzes their employment features. They have an increasing preference for certain occupations and have a stronger sense for appeals of labor interests.The third chapter chiefly makes an analysis on positive meanings of Employment Promotion Law of the People's Republic of China and Labor Contract Law of the People's Republic of China on migrant-worker employment.The fourth chapter illustrates how unprotected labor interests of new-generation migrant workers lead to labor-management disharmony and further social instability.The fifth chapter analyzes reasons for employment problems among new-generation migrant workers, mainly systematic reasons.The sixth chapter put forward suggestions on suitable legal environment to improve and promote employment of new-generation migrant workers. We emphasize on perfecting related regulations in Employment Promotion Law of the People's Republic of China and Labor Contract Law of the People's Republic of China.The sixth chapter concludes that we need to promote employment of new-generation migrant workers by new thoughts.
